By using our Services including exhibition and workshops or ordering our product, you are agreeing to these terms. Please read them carefully. Please also be informed that these terms and conditions, may be amended from time to time, apply to all our services directly or indirectly.

CONTRACT

This is the user agreement between the customer and the Company. The terms “we”, “us” and “Company” refers to www.firstwishartgallery.com and “you” refers to the user/customer purchasing product though us directly through this website.

The customer  is obligated to submit a proper payment with the acceptable payment methods as well as respect all the policies related to customer conduct.

www.firstwishartgallery.com  is obligated to complete the order processing and shipping according to their policies and the descriptions of the online publication of the purchased product/s.

PAYMENTS

All prices on www.firstwishartgallery.com are in Euro or USD as per current exchange rates.

We use a PayPal & Credit Card Payment system; at checkout you’ll have the option to select your preferred payment method and will be taken through a secure checkout.

We reserve the right to change these terms, conditions and notices and you agree to accept and be bound by the terms, conditions and notices that are in effect at the time of your use of our website and facilities. Upon accessing and/or using www.firstwishartgallery.com you agree to be bound by these TERMS OF USE.

TRADEMARK

All the trademarks, the logos must not be used without the prior written consent of the Company.

This website www.firstwishartgallery.com  should be used only for the purpose for which it is intended. In particular, you agree that you will not make any unauthorized, false or fraudulent purchase.

COPYRIGHT

All artworks are Copyright  and protected under Copyright Law. It is prohibited to re-produce any piece of content, or to use for commercial purposes unless otherwise agreed. Specific usage for commissions and brand or business projects is to be agreed at the time of commission.

First Wish Art Gallery reserves the right to produce and sell prints of each and any artwork in the future.

DISCLAIMER

www.firstwishartgallery.com does not and cannot review all communications and materials posted to or created by users accessing the site, and are not in any manner responsible for the content of these communications and materials.

You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, www.firstwishartgallery.com is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, www.firstwishartgallery.com  reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to www.firstwishartgallery.com in its sole discretion.

IMPORT DUTIES AND TAXES

b) We recommend to check with the customs of your country to estimate the amount of the duty or if any taxes apply.

c) The taxes and duties are usually charged by the delivery company as cash on delivery. You can also pay them online and by phone before the delivery.

d) We do not cover import duties and taxes related to the import of the painting. Such taxes are the responsibility of the customer. However we do compensate you in a form of store credit for future orders in the best way.

e) For Example, if you pay $25 import tax when you get the package, then next time you order from us you get $50 discount.

SHIPPING & CHARGES: ONLINE ART SALE

​We offer shipping worldwide – Our main clients are from Europe, GCC and Asian markets.

If product price is less than One Thousand Euros then we need to charge fee for shipping worldwide.

The turnaround time from order to delivery of items made on demand is maximum 15 to 30 days depending on location. We try to get it done within 15 days as much as possible.

FWAG ARTSHIP EXPRESS: For International Exhibitions

Point to be noted:

We provide shipping assistance for international exhibitions through our “FWAG ArtShip Express” Shipping Handling Service.

1. If artists are unable to travel but wish to exhibit artwork internationally, we offer the option of shipping assistance upon request.

2. Depending on the specific exhibition, our shipping services may be provided free of charge or with a nominal fee of 55 Euros. This fee, if applicable, covers various services associated with transportation, including airport packing, airport transportation, and related logistical support, excluding customs fees.

3. Artwork size must be less than 80×80 CM only, including Stretch on Canvas. Please use cardboard and bubble wrap packing.

4. Return of artwork after the exhibition is possible within 90 days according to our gallery schedule.

5. Important: First Wish Art Gallery is not responsible for any damage, misplacement, or theft of artworks during the exhibition, as well as during transport by any couriers, shipping companies, or airlines.

RETURN & REFUND

All sales are final and we don’t do refunds. A return is only possible if product is damaged or incorrect within 30 days from the delivery date. You can exchange it for an equally priced product alternatively.

NOTE – FOR EXHIBITION REFUND PROCESS: We have NO REFUND policy for any exhibition’s registration fee or work shop registration fee.

Exhibition Replacement: In the event that you find it necessary to cancel your scheduled exhibition, we offer the option of rescheduling your exhibition in a different gallery or museum, subject to availability. The replacement space will be of the same size as your original booking, ensuring that your artistic vision is not compromised. We understand that unforeseen circumstances can arise, and we are committed to accommodating your needs.

Cancellation Procedure: Should you wish to cancel your exhibition registration, we kindly request that you notify us via email at least 30 calendar days before the scheduled opening day of the exhibition.

This advance notice allows us to make necessary arrangements and adjustments to our exhibition calendar. Please provide your cancellation request in writing to  info@firstwishartgallery.com,  stating your intention to cancel and the reasons for doing so.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless www.firstwishartgallery.com, its directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

TYPOGRAPHICAL ERRORS

In the event that www.firstwishartgallery.com product is mistakenly listed at an incorrect price, www.firstwishartgallery.com  reserves the right to refuse or cancel any orders placed for product listed at the incorrect price.

 www.firstwishartgallery.com reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will issue a full credit back to your credit card account in the amount of the incorrect price. www.firstwishartgallery.com is not responsible for typographical or photographical errors. Prices and specifications are subject to change without notice.

LIMITATION OF LIABILITY

www.firstwishartgallery.com shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if www.firstwishartgallery.com has been advised of the possibility of such damages.

CANCELATION POLICY

Orders must be cancelled via email only and with a confirmation by our representatives in writing. You can submit a cancelation request by email and follow up with a phone call.

Please be noted that refused shipments may be subject to a reduction of shipping and return fee.

By placing an order over the phone or on any of our official social media pages you (“Customer”) automatically agree to accept our Terms and Conditions.
